Hello,

This is what happend:
I don't know how the accident happend and the driver claims he doesn't remember either.
I woke up in the hospital about 5 weeks after the accident.

I was working away from home, I didn't have a car, So I usually went with some of my co-workers in their cars.

So this night in particular we worked late until 1:00am , While driving home we decided to get something to eat, I decided to take a minute nap in the front seat.

Well here is my problem:

The driver does not know what happend!
The car he claimed was his, Was in fact his girlfriends car.
He had a fake drivers license!
The car was not insured at all.
He doesn't have money!

When his girlfriends father heard that the doctors were thinking turning off my life support. They actually went to my father and asked him if they can't say I drove the car!

My father luckily just ignored them. ranting2.gif

He has no money, Can I sue him?
I can't claim 3rd party damages.
The R25000 that I could have gotten from The road accident was taken by the hospital.

It's hopeless!

Hi. Sorry to hear what happeneed. Are you sure they do not have assets. ? Afraid I cannot be of much use to you, maybe somebody else will come up with ideas. Maybe Paul Breen will come on line, or if yhou look through the forums you will find his link.

Sue him. Force him into bankruptcy. That's what I had to do. The drunk that hit me was actually going through a divorce when the accident happened. After I won my suit, he ended up filing for bankrutcy pretty soon afterwards to pay the settlement.
