I need help! Has anyone had this happen? I was driving home one night, the police decided to chase another car for crossing the double yellow line. The car fled and the police continued to pursue. Speed limit was 30 mph they went well over 100mph. The car they were chasing blew a red light a hit me just in front of the drivers door at 115 mph. The driver was drunk and on drugs, had no license or insurance and was driving his friends Escalade. Why do police chase people this fast for minor offenses? Do I have a case against the police? I broke my neck, c5/c6....

Sounds crazy.. You need to talk to a lawyer for sure.

I'd go after the owner of the Escalade.

edit: in court, that is.

I'm surprised you are posing this question here vs. going straight to an attorney. That's a no-brainer... consult with a legal representative.

Yeah, call an attorney. I'm sure you have at least a double lawsuit if not triple - Escalade, Police Officer and whatever city or county employs the officer!!

Hey welcome to the site and I'm sorry for what happen to you. As retired cop I can tell you that all police departments have different pursuit policies. Most have a NO PURSUIT POLICY for anything short of a life threatening situation. Many time I had a road supervisor terminate one of my pursuits due to the fact the pursuit was more dangerous to the public than letting the suspect go. However many cops claim the never hear the order to terminate and continue. I know a few guys including me that did that because your caught in the moment. From what I have noticed from lawsuits I have known to be filed, you have a GREAT CASE!. Thank god I never hurt anyone but myself in an accident! Any more questions just holla!
