My sted dad is a quadriplegic with a medical set aside account. He along with Risk Management has hired my brother to be a caregiver. My brother has a criminal record with no felonies. I myself have a felony but are unabled to be hired. My step dad signed a waiver allowing him to work for them. Now i've been told by his CPA that i can't be hired due to me being a risk. He said even if a waiver was signed his firm would take on all responsiblities. Is there a way, or loop hole if you will, for me to be hired. By us working for them we save hi him heaps of money. We do his massage therapy, range of motion, physical therapy, and cook, clean, bathe, etc. I think you get the picture. At $10 opposed to what professionals would charge I think he's benefitting by using us. So is there any way possible for me to be hired. Thanks in advance. I can be reached at parcusgrav@yahoo.com

Hi there -
a question to make sure I understand your situation ...
Your felony prevents you from being hired? Did you check out the ADA? www.ada.gov/
especially the section on Equal Employment.
Also try Overview of State Laws That Ban Discrimination By Employers www.lac.org/toolkits
Because you have no location info in your profile, it's hard to answer your question well. Employment of a felon is handled differently, state to state.
Hope this will help some. Good luck.

I think it's great that you want to work taking care of your father. Working for the state however is a different story. Even if it is a family member you would be working for, they can deny you employment based on a felony conviction. Consider this... Suppose the agency hired you to work with your father and you stole something or in some other way intentionally harmed your father. Your father can then turn around and sue the agency because they hired a known felon and knowingly put him in a dangerous position. Your father can agree to you working with him all he wants, but ultimately it's the responsibility of the agency to hire safe, responsible people.
If you want to work for your father, then work for your father. Maybe work out a deal with rent, food, etc. instead of an actual paycheck. Felony convictions follow people throughout their lives. It's something you'll just have to deal with.

I would be very surprised if convicted felons are covered under the ADA. I certainly hope they aren't, but this is America...
