How Much Compo?

How's this. I read in the paper today of a guy in UK who is seeking £8 million compo for spinal fractures received in a crash in 2003. His wife was expecting their first child at the time but they wanted 3 of a family. So, he is claiming for IVF to enable the other 2 children to be born.

Given my present circumstances - car crashes off the road, nephew is permanently crippled - I suffer 2 broken legs, broken arm and a life threatening injury - could I claim for the fact that before the accident I always wanted a Ferrari!!

Is this the new way to go - claim for the things you wanted BEFORE the accident?

Wonder how much I would get if I claimed for my dreams. Must remember that when I come to see the solicitor.

Hi Gary,

In the US, compensation is supposed to include things like pain and suffering, loss of future earning capacity and loss of happiness etc. I don't see what's wrong with listing the things you'll be denied due to an injury to further explain your case in a lawsuit or arbitration. Here in the States a surviving spouse can also sue for things like "loss of companionship".

You should be made as whole as possible. Including the cost of IVF doesn't seem out of line to me. Before the injury, getting his wife pregnant was a fun and loving thing to do... now it's a chore and a costly medical procedure.

In the US, the government has nothing to do with compensation. It's left up to the private entity who is responsible. A very underinsured motorist crashed into me. Back in '79 all I got was $10,000 for "pain and suffering" and $2,500 for my motorcycle and a permanent case of T-5 paraplegia. Had the negligent motorist been properly insured or wealthy I could've sued for millions and collected. Here in the States, if someone injures you, first make sure they're fully insured or independently wealthy. In other words get hit by a deep-pocketed Fed Ex or UPS truck!

In the US, you wanting and getting a Farrari would be covered under loss of future earnings or loss of happiness! Vroom, vroom.

I think it's crazy the things that you can sue for here in the US. I had a one-car accident not much debt of who’s at fault, one of my friends was in the car with me. I hit a ditch, flipped and over end 5 times and rolled 400 some feet. I broke my left arm and back, my friend had a bused body. He was out of work for one week. My auto insures paid for all medical bills and willingly gave my friend $5,000 for pain and suffering. Then my friend tried to sue my father for another $15,000 the judge pretty much said he’s crazy and dismissed the case.
