Can You Be Refused For Home Care?

My Mother in Law is currently in an extended care facility, she is 62 and in frail condition, a C2 incomplete injury quad, we have been trying to get he approved for 24 hour PCA care as she will be living alone. We were told the best she would get would be 12 hours a day, max. Now we have not heard back and we are afraid that they may come back and say she can not leave the extended care facility (nice word for crappy nursing home) Can they do that? Has anyone been in a similar situation? I'm hoping her age is not playing a factor? It all doesn't seem fair!!
