Anybody Have Medicade? Please Help ME! Rate Topic: -----

[b]Long story short, my boyfriend was a pedestrian in a hit and run by a drunk driver for the U.S. Army. So far medicade has cut my boyfriend off completely which they have made clear they will no longer cover medications, transportation, dr. appts, and breathing equipment. He is a quadriplegic and is on humidified oxygen at all times. Can medicade take his breathing machine and supplies from him if he cannot pay for it? Currently the case against the soldier is not good, they cannot prove he was behind the wheel and if they could that any sort of money we recieve, medicade will take back. He was only approved for 900 dollars for disibility a month which is less than half what he made before the accident. Medicade will not pay for home health aides to help either.....Please help is this right? Isnt taking his breathing equipment away if he can't afford it murder?

He should be on Medicare which would cover the meds, etc. Medicaid is state administered, so each state is different. You should contact the area Agency on Aging...they also help people with disabilities. Also reach out to the Masons/Shriner organization and other non profits. It is illegal to leave a person at home in a vulnerable/unsafe condition at home. Certain states, especially now during the "Great Recession" have severely cut back because of lack of funds, which can force someone in his condition into a nursing home, which is a horrible place for a young person. You also need to talk to another attorney....the "owner" of the vehicle, also if it was a military vehicle, it was checked out to someone...that person would be responsible.

Also check with your boyfriend's auto insurance - (even though he was walking the accident involved a vehicle). My BF got bad advice from his attorney, and since he didn't file a claim with his auto insurance co. following being hit, he was denied an award because the statute of limitations ran out.

why does he not get his medicare?

I don't want to add to the confusion here
But it makes me wonder why people knock our NHS here in the UK when such horrendous stories like this appear

I do hope you find a resolution befor you start bangin your head against a brick wall
I don't understand the medical insurance situation you guys have to deal with but continue with a law suite against the military as they are responsable for the vehical no matter who was driving
If there was witnesses surely you would have a case
Looks like you gotta find a good accident lawyer

They knock it for political reasons, not for reasons based on facts. I don't want to get into a pissing match, though I'm fully prepared to, with anyone who may swing right-of-center on the health care issue in this country, so I'll leave it at that.
