i was involved in a rollover. it was my truck. i will swear by my life that i do not know what happened. tonight i was served with papers. i have four seperate lawsuits that say that i am going to have to come up with something. there was a single passenger in my vehicle. he did sustain injury. 2 broken ribs, and a pinched nerve that causes a twitch in his eye. i on the other hand sustained 2 broken ribs, a liver laceration and a complete fracture of the t12 vertebrae. i am being sued by both the passenger and his wife. like i said, there are 4 different suits. because my mothers name was on the title of the truck, she got two of the four. she on the other hand was 400 miles away when the accident accured. i am currently broke do to paying of the thousands of dollars in medical bills and rehab. someone please tell me it is going to be alright. i know i live in a country that is obsessed with lawsuits. i don't need to hear that. but it has been 8 months since my accident. there have been times were i have embraced my disability. there have been 2 separate times that i have been asked back to my rehabilitation hospital to talk to other people with sci's. today was the first time that i have questioned whether or not i can actually do this. at the time of the accident i was given two different tickets. one was failure to control a moving vehicle, the other was a DUI. I was not drunk and i have documentation to prove that however both tickets were dropped. looking at the accident report both of us were ejected from the vehicle but it does not show were we landed. is there more information that can be found calling the police department? do they take photos and document were we landed. id like to know if i was driving the vehicle. even though it was my vehicle i let everyone drive it. someone please help.

I'm so sorry to hear about your legal problems, I wish I could be of more assistance to you but we do not have the right to sue here (completely different legal system altogether). Seems there will always be those who take advantage. From what I read it was just an accident and personally I think since you are the one that was significantly injured as a result your focus should be more on your recovery & rehabilition...Is there someone that you know that would be able to assist you with some of the ongoing legal difficulties? as this would surely ease the burden on you.
I hope you are able to find someone to discuss this further. It's sounds awful for you to have to deal with this so soon after your injury.
I can relate in that we have had other legal issues concerning disability that have gone on on the side lines for decades and I know how draining it can be when it seems to be coming at you from all sides all the time. Take a deep breath, take one day at a time and try not to get too overly concerned about the what if's...otherwise they will overwhelm you.

OK you say you weren't drunk but you question if you were driving? That doesn't really matter since they probably took your blood and all you have to have is 0.08 and then you are legally drunk as far as the DMV is concerned. If I drank 1 beer I would show 0.08. Anyway.....
How screwed up is it; was the car insuranced? If it was you better believe the people will not let up on the suits. I am so sincerely sorry that you are going through this. It's hard enough to get acquainted with the wheelchair but people hounding you, papers being served. Do you have a lawyer?
The best thing you can do is get fit to fight. Don't let yourself go in self pity. Eat, exercise, and think positively. I know it's hard but the worse shape you're in the worse it will be. You need to be fit while you're being sued.
Get the police report, embrace your situation (that's the only way you're going to make it), and find out what the heck happened! It should say on the papers what happened. You were served papers so look and find out who the attorney is. Get an attorney; if you can't afford one call legal aid but do it fast. The scene should have been photographed.

the car was insured my BAC was .067. looking at the accident report it just shows the path in which the truck was travelling.doesn't say were we ended up. looking at the vehicle it rolled over onto the right side. my spine was pushed in. right side of the truck was worse then the left. i remember everything until getting into the truck. it was supposed to be a 4 day vacation. this kid since the accident has had the balls to still talk to me on facebook. luckily he does not have my phone number to actually call me. i live in illinois. he lives in wisconsin. my accident happened in wisconsin. but he has come back down to illinois. he has tried to see me. and at first this lawsuit was only going to the insurance company. i new that a while back. $100,000 is a lot of money. and if properly spent that will last you at the most 2 years. there is history with his family. i got his step brother arrested for vandalizing my truck. his step brother did $3400 in damage to it before my accident. i know some how some way i will get through this. the problem is i went from being extremely happy with working to not working. all i enjoyed doing was helping people do things they didn't feel comfortable doing. it is just a sense of helplessness. that is what makes me angry. i was doing well. i did have so much going for me. i had a 50k a year job. i had my truck 3 motorcycles. looking into buying a house. and i have none of that now.

I was not sued, but accused of something horrid by neighbors, no less, long ago. The basis was that I told tasteless jokes. I was terrified and beside myself for 6 months until I finally got word that the police would not file charges because they did not feel there was reasonable evidence.
So I have a memory of how bad you must feel. You WILL be ok because you will eventually get it that this is not personal- people in the US really do sue just because they see it as a way to make a buck.
You will be OK. Your Mom will be OK. In must countries you have the right to the police report. Just ask and whatever they have will be in there.
They clearly had some reason to believe you were driving, and it will be there.
You will be ok, and it will take time because you are not just dealing with being sued. You are confronting the realities that life is not fair and that people can be horrid. It will be a game-changer.

Ah Tom, if you do not have assets, they are suing the insurance company...they will sue it for a scratch on their arm, simply because there is an attorney who will take a case...enough of that...as far as your situation: you have a lot of info, see if there is more, as stated above...do as much research...your insurance company should provide an attorney for you, so no cost directly to you, as they are really protecting the interests of the insurance company, but they are your attorney as well, as defendant...
As stated above [so much good info in the previous posts!] besides your research, please focus on your health and taking care of yourself...please do the work above, but try not to focus on all that, but stay focused upon yourself...the lawsuits will sort themselves out in about 5 years, and as long as you have your info, do not be concerned with this now...be inot your Life....
