I just went through a disabilitiy review and lost. My spinal cord injury is at the c5-c6 level with nerve damage in my neck and lower back, neurapthy, bone spurs at every level of the cervacal spine as well as other deginerative disease in the cervacal area. The reason they said I was no longer disabled was I was able to stand, walk and move about in a satisfactory manner as well as use my hands for basic grasping and handling. They said I was previous met the disability requirments because my back met the conditions. Well my back never has been the problem so I don't understand this reasoning. All my doctors told me not to worry about this review that it was routine including the doctor they chose to send me to. I did question why they were taking an x-ray of my lower back during the visit to the doctor they chose me to see and he said he had no idea. They just asked him to do the x-ray. He said it would take a miracle to fix a spinal cord injury not to worry.
Well when I was turned down I went back to my oringinal attorney thinking that was the logical thing to do since he still had all my file information. I went right down to the social security office as he told me and filed the appeal and also filed to continue my benefits. My attorney told me the process would take about 14 months to get straightend out. Well at the beginning of October I was informed through Humana that my insurance was being cancelled because I no longer would have medicare parts a & b. So I called Social Security and they told me my local office did not put my paper work through. I also called my attorney and my case worker and was told everything would be fixed by the following Tuesday. i waited till Wednesday Oct. 12 to call my insurance to give plenty of time to make sure everything was fixed and my medicare still wasn't fixed. When I called social security they told me that the local office had 30 days to from the date I called (oct 4th) to fix the problem but my payments would continue. It was only the medicare that was an issue. They aslo told me not to call the local office or go down there. Well I certainly did call my case worker and my attorney. My case worker did not call me back and my attorney said he really didn't deal with medicare problems. I told him this was part of the appeals process he should be handling it but he seemed to disagree. So the next day I went down to the local social security office. One of the first things they asked me was "who was my attoney and why was he not handleing this?" They told me they were working on it and hoped to get it fixed before the end of the month. They also told me that just to get a hearing is taking up to a year in some cases. So who do I believe? My attorney said 6 months on the hearing and is there anything I can do to make sure I don't lose my medicare? I do have the original paper work I filled out date August 23, 2011. And what do I do about my attorney telling me conflicting information?
If anyone has any answers or suggestions I'd like to hear from anyone. I'm new to this site and I feel like I don't have a voice.

Check out the Free Music To Those That Want It For Relaxation in the Cafe Apparelyzed section. Some music is even upbeat. I'll try to continue to add artists and music there!
