Ok this is more specific. Has anyone been through a disability review? What should I expect from my attorney? Should the attorney be knowledgeable about making sure I don't lose my medicare/medicaid?

Hope I can get some answers on this! Thanks to anyone that might give me some insight!

If anyone is reading about my disability review I will post updates in hopes of helping anyone else that might have to go through this. My Social Security case worker called today. She told me that I'm just waiting for a hearing with a medical person. This won't be an exam. The person will already have my medical records and I guess will ask me questions. It has been terrifying to have to try to work with Social Security, Medicare, Medicaid and my health insurance to make sure everything was in place so I didn't lose any benefits during my appeals process. Just so you know how long the process is taking I appealed the disability review decision on Aug. 23, 2011.

The bad news I learned today is if I lose at this hearing, I have to appeal again and make sure all government agencies and my health insurance get all the correct information again. The good news on that is I know how to do it now and who to call.
I have no idea on the date of this hearing. I was told that the holidays are coming up and people will be taking off work so I'm not to expect anything to happen anytime soon. My attorney doesn't help with any of the processes dealing with the other government agencies. He says he is just there to get my disbility back, I have to fight to keep my benefits going while on appeal. Seems a bit silly since if I lost my benefits I wouldn't be able to pay him but I must be going through this for a reason.

Hopefully someone else will read this and if they need help they can ask me anything. It feels hopeless at times, it's hard to find the positives especially when you don't feel good but I know HOPE is there.

I made sure my VA Doctor wrote me a letter on VA letter head paper saying "Harry3082 is perminatly Disabled" so I could avoid your problem!

I am very confused about you post. If you have a spinal cord injury and your records say so why did they take your benefits away? A disability lawyer is suppose to help you. I am not sure what kind of lawyer you are using. I got perm disability from day one but they have the right to review every 5 years but I don't think they do from what I hear. It seems like you are one of the unlucky few. I supplied them with 80 pages of doctors records for them to see so there was no question.

I agree with slimjim that you should get records to say permanently disabled.

I got my SS disability right off the bat no hassles with a seven year review...You said you originally filed on your back and when they cut you off they claimed your back was OK now....Were you given your original disablility on your back condition and not SCI? If so you may have to re-file on your SCI...What you write is kinda confusing on that point...

I am on my second attempt to get my disability. I applied back in 05 and my GP would not stand up for me in the paperwork they sent him to fill out GRRRRRR. So now I have an orthopedic and it is my hope she stands up and helps. It truly blows my min that a child with ADHD can get disability, but i cant AND a man with heal spurs can gt a handicap parking pass but i cant, GRRRRRRR. Ill get off my pedestal.

Yes it said i was disabled due to my back but I never knew that. I never got anything saying that until the review saying I was able to work again. I got good news though today I will post at the bottom. Thanks for your comments and everyone else that is commenting. It was confusing to me that I had a c5c6 spinal cord injury and was disabled because of my back.

I got great news today! I received a letter for disability saying I am now considered disabled again. Now how they came to the conclusion and on what grounds I have no idea because again as in the original decision it doesn't say. I'm certainly not going to appeal it and not sure how to find out on what grounds they have made this decision. I won't have any hearings. It's just an answer to my prayers is all i can say. I had to jump through some hoops to keep my benefits because social security never filed my appeal to keep them but i got it done and know what to do since my attorney didn't help; me in anyway. I'm sure I will still owe him his minimum fee since I singed a contract with him but I'd rather pay and be over this because it was very stressful. If anyone ever goes through a review and needs help, just ask....................

Don't worry about what grounds they denied or accepted you by, you have it now. Start concentrating on what benefits you now have and start receiving them!!!!
