Really sorry to hear you aren't well- and about your job. Can't believe that someone could act like that in a position of "responsibility" and get away with it. At least you ave emails etc- get yourself stronger, then you can decide if you want to take it further. Take care. Xx

Glad you are feeling a bit better.

As for the work issue, just be careful you don't run out of time to lodge your complaint. I am not sure but it might be 3 months.

Jules - I am so sorry to hear of your tough times - I can't believe how much you have been challenged... keep fighting girl.
I used to be an advisor, but my knowledge is really out of date now. However I can tell you that you were entitled to have someone with you as your representative,(be that a union rep or other work colleague) - if they breached this (which it appears they did) you should ask what the grievance procedure is and start the ball rolling - sooner rather than later... keep within stated timelines, and document EVERYTHING! Tin is correct that you may have grounds for a constructive as well as breach of the DDA... I know you won't feel like doing anything, but if you are able to, start the process now. GET ADVICE NOW

i hope this helps - don't want to advise you anything more detailed at this stage as I say I have been out of practice for 6 years

Dear Jules,

I'm so sorry that you are poorly and I wish you a speedy recovery.

On the subject of taking legal action against your former employer, you should contact ACAS immediately the time frame in which you are able to file for unfair or constructive dismissal is very short. The fact that you have been in hospital and very ill is on your side as it is a legitimate reason for falling outside the time frame. My son tried to go for constructive dismissal but because he didn't file immediately, but waited while it went through internal appeal he fell outside the timeframe.
File now in person and when you are well you can appoint a representative. They have failed you on a number of counts, disability discrimination, breach of employment law (treating one person differently from another) and negligence in allowing you to leave work alone when you were in distress and ill (putting your life in danger). I do wish you well with this but please don't delay, you can always drop the action and it won't cost you anything. Right now your ex boss will be thinking that she has got away with it again and a shot across her bows is just what she deserves.
