hello, i am new to this forum. my wife was partially paralyzed as a result of spinal cord surgery (removal of old / insertion of a new stimulator paddle) a few years back. the surgeon admitted his error after the procedure. since then we've encountered problems with dsicriminatory behavior at a local club we used to attend, and difficulty finding another doctor willing to submit an opinion that medical malpractice is indicated in my wife's condition. we made an ADA complaint, willing to go through mediation and all that, but find our conselor is not very supportive despite clear violation of the law.
generally we're finding that the help and support we'd been counting on with the law, and with malpractice claim is tenuos at best. as her husband i get the feeling that people with her condition should not be seen and simply 'go away.'
have others encountered this discrimination, should we be more agressive, contact our state Senator?

Have you contacted an attorney? A private malpractice attorney? If not, that's the first thing I would do. If you have and that attorney isn't helping you then I'd fire him and hire a new one. Your attorney should be able to get your wife into a doctor who can review her medical records and do an exam and testing to verify malpractice.
Concerning the club I would file a complaint against them with the better business bureau if all else fails. If your ADA counselor isn't doing her job then talk to her supervisor. If that doesn't help keep working up the chain of command, making complaints against each person who fails to do their job along the way.
Don't give up or allow it to be swept under the rug! If all else fails contact your local news station about how the system set in place to protect disabled Americans is failing you.
