Hello Everybody.

I was wondering if anyone had any info on retro disability checks. We were told we would get one and now they are saying that we're not. I'm a little pissed off considering that we were under the impression that we would get the $$$ back so I went ahead and tapped into our savings account only for them to tell us "too bad for you" .

Any suggestions is greatly appreciated!!

It depends on when they considered you legaly disabled by their standards. Social Security figures you can survive on you own, without any income, for about 5 month, so they knock off about 5 months of that "one year" that they talk about in the "retro" crap they talk about.
If the Army and the Navy ever look on heavens scenes,

Bens accident was in Oct of 2006...he is basically living on a wing and a prayer...if he was not living at home with us he would be on the street by now, NO INCOME and SS seems to not give a shit!!! Very frustrated as we are tapped out as well...how do they think we pay for the gas, ect to get to appts plus all the other expenses??? Thanks For Listening

In Belgium, no matter how disabled you are : the government check your income and if you have over 1 000 $ per month, you are no more considered as a disabled ...

SOOOO SORRY! I fixed it!

I feel like we're getting ripped off here! Should I keep calling and bugging someone or should I just accept the fact that we've been lied to and screwed over?? Any Suggestions!

Yes! You should complain. If a person has been awarded SSDI, they are owed full benefits starting 6 months from "the date of injury". You should have a letter stating your monthly benefit and the date your benefit begins. In addition there should be a local SSA office to contact. This is where your unfortunate travails begin.

Like what another poster said, find out exactly when you were declared disabled. The hospital social worker can help with that. I'm not sure of the max back pay you can get but I got 6 months lump sum worth about $3600.00. At this time I get about $730/month. But evert raise I get, medicaid increases my deductable. I can't get more than $658/month. That doesn't pay for much.

It took over 1 1/2 years before I received my SSI. I did manage to find it type of loophole. Since I am a typically poor person I tried to receive all the benefits possible. The first thing I found is that if I went to a nursing home for three months I would be eligible for CBA (Community-Based Assistance) instead of waiting three years. After I received CBA, I applied for TRC (Texas Rehabilitation Commission) or DAARS and they were happy to help and paid for rehabilitation therapy. A lot of this depends on age, country, and state. On the other hand every state should have a type of assistive resources such as TRC. When I was finally approved for SSI, they ended up with back pay. (Back pay would be what SSI had to pay for waiting so long). This was a long process and did not happen overnight. I guess what I'm trying to say is be as aggressive as possible. It is the only way to deal with these people. If you have any more questions feel free to ask.

Another thought, is that if they are still screwing you around then go ahead and contact an ADA attorney (they are free) and they will take your case to court and make SSI comply with the ADA rules. These attorneys are somewhat hard to find, the Internet would be your best source in finding a phone number, it might even be in the phone book.

It took 6 months exactly for my social security to come, and it wasn't retroactive.
